1. Acceptance of Terms

By accessing or using Swyft (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users, including business owners, their employees, and any third parties who interact with the Service on their behalf.

2. Description of Service

Swyft is an AI-powered lead response and booking platform for home service businesses. The Service includes automated lead responses, job qualification, estimate generation, calendar integration, and follow-up sequences. Swyft is provided on a subscription basis.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at hello@swyft.ai if you suspect unauthorized use.

4. Subscription and Billing

Swyft is billed on a monthly basis. You will be charged the plan rate on your billing date each month. All fees are non-refundable except as required by law or as explicitly stated in these terms. You may cancel your subscription at any time; access continues until the end of the current billing period.

We reserve the right to change pricing with 30 days' notice. Continued use after the effective date constitutes acceptance of the new pricing.

5. Free Trial

New accounts receive a 14-day free trial. No credit card is required to start. At the end of the trial, you may choose a paid plan to continue using the Service. We reserve the right to modify or discontinue the free trial at any time.

6. Acceptable Use

You agree not to:

  • Use the Service to send spam or unsolicited communications
  • Impersonate any person or entity
  • Violate any applicable law or regulation
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse engineer, decompile, or disassemble any part of the Service

7. Intellectual Property

Swyft and its licensors own all intellectual property rights in the Service, including software, content, and trademarks. These terms do not grant you any ownership rights. You retain ownership of any content you provide to the Service, but grant Swyft a limited license to use it solely to operate and improve the Service.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. SWYFT DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWYFT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR REVENUE, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. SWYFT'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE TWELVE MONTHS PRIOR TO THE CLAIM.

10. Termination

We may suspend or terminate your access to the Service at our discretion if you violate these terms, with or without notice. You may terminate your account at any time through your account settings or by contacting us. Upon termination, your right to use the Service ceases immediately.

11. Governing Law

These terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Travis County, Texas.

12. Changes to Terms

We may update these Terms of Service at any time. We will notify you of material changes by email or prominent notice on the Service at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
